One of the four defendants, accused in the Rhoden family murders has waived his right to a speedy trial.
Edward Jake Wagner, the youngest of the accused, appeared in court on Tuesday morning in regard to a motion hearing. Wagner waived is right to a speedy trial through January of 2021. That means it could potentially be more than a year before his case goes to trial.
Wagner’s council also set a cut off for fact-specific motions for November 1st. He is due back in court for a hearing on October 8th.
The father of the accused family, George Billy Wagner, was scheduled for a court motion hearing on Tuesday afternoon. He’s been assigned a December 9th pretrial hearing.
Angela Wagner, the mother of the two boys and wife to George Wagner, appeared in court on Monday in regard to a breach of a court order restricting communication between the accused family members. A court judge revoked her writing and phone privileges as a result.
Rita Newcomb, Angela’s mother, who is charged in connection to the case, appeared a court in late August as a result of the breach of communication, between her and her daughter. She was admonished by the judge but was ultimately allowed to remain free on bond, under electronic monitoring.
